This privacy policy describes information collected on hwogapparel.com and all affiliated domains that link to Having the Will Of God, and through any location where this policy is posted (collectively referred to herein as the “HWOG”, "Sites", "we" or "us"). It also explains how your personal data is used, shared and protected, what choices you have relating to your personal data, and how you can contact us.

 

CONSENT:

BY ACESSING THE SITES OR ALLOWING SOMEONE TO USE THE SITES ON YOUR BEHALF, YOU ARE CONSENTING TO THE COLLECTION, USE, DISCLOSURE, TRANSFER AND STORAGE OF PERSONAL AND NON-PERSONAL DATA OR OTHER INFORMATION RECEIVED BY US AS A RESULT OF SUCH USE IN ACCORDANCE WITH THIS POLICY.

 

What Information Is Collected and When?

Personal Information

We may collect Personal Information from users of the Sites in several instances. We ask you for certain personal data to provide you with the products or services you request. For example, when you make purchases, contact our consumer services, request to receive communications, create an account, participate in our events or contests, provide feedback in surveys, or use our Sites.

This personal data includes your:

  • contact details including name, email, telephone number and shipping, billing address

  • login and account information, including screen name, password and unique user ID

  • personal details including gender, date of birth, and purchase history

  • payment or credit card information

  • images, photos and videos

  • data on physical characteristics, including weight, height, and body measurements (such as estimated apparel size)

  • personal preferences including your wish list as well as marketing preferences

We also may obtain, collect and aggregate information (including Personal Information) provided to us by our marketing service providers and other vendors. That information may include information on current subscribers or customers and is used for a number of things including enabling us to send you the most relevant, timely and exciting offers and announcements specifically tailored for you and your interests. Of course, you can update your information or change your preferences regarding receiving announcements and other information from us at any time by accessing your account via the Sites.

The above section provides examples of the Personal Information that we may collect through the Sites and the manners in which we may use such Personal Information. If you do not want us to collect your Personal Information, please do not provide it to us.

 

Electronic Information

You do not need to create an account with us to use the Sites. When you use the Sites, including by browsing our merchandise and/or contacting us with inquiries, we collect certain electronic information, some or all of which may not identify you ("Electronic Information"). The Electronic Information we collect includes, without limitation, Internet Protocol (IP) addresses, Internet browser information, other characteristics of your device and software, domain names of your Internet Service Provider (ISP), your approximate geographic location, a record of your usage of our Sites, the time of your usage and aggregated Personal Information that cannot be used to specifically identify you. By using our website, you (the visitor) agree to allow third parties to process your IP address, in order to determine your location for the purpose of currency conversion. You also agree to have that currency stored in a session cookie in your browser (a temporary cookie which gets automatically removed when you close your browser). We do this in order for the selected currency to remain selected and consistent when browsing our website so that the prices can convert to your (the visitor) local currency. Such information, which is collected passively using various technologies, generally cannot, in and of itself, be used to specifically identify you. This information is used to analyze and to improve the Sites and to provide our customers with a fulfilling shopping experience. If non-personal Electronic Information is combined with Personal Information, it may be viewed as Personal Information. However, where the data remains non-personally identifiable, it will not be viewed as Personal Information. We provide additional information on our Non-Personal Information collection below:

 

Cookies and Other Session Identifiers

Like many sites, we utilize a technology called "cookies". A cookie is a piece of information that is placed on your browser when you access the Sites. In many cases, the information collected using cookies (and related technologies) are used in non-identifiable ways, without any reference to Personal Information. For example, we use information we collect about users of the Sites to optimize our Sites and to understand traffic and usage patterns. In other cases, we associate the information we collect using cookies and related technologies with Personal Information. In that case, this Privacy Policy governs how we use that information. Additionally, if the settings on your location-aware device allow us to receive geo-location data or information, we may collect that information automatically.

Cookies help provide additional functionality to the Sites and help us to more accurately analyze usage of the Sites. For instance, the Sites may set a cookie on your browser that allows you to access the Sites during future visits. We use cookies to monitor and to maintain information about your use of the Sites. Cookies are also used to track the identity of the website you visited immediately prior to visiting the Sites; other than that, we do not track information about your use of other websites. Cookies also allow us to hold selections in a shopping cart when a user leaves the Sites without checking out. Cookies are not used on the Sites to store your account information as this information is stored securely on a server. When you log in at the Sites with your username and password, we will assign you a secure session id. The server then passes your information to you through this secure session ID. Cookies may be session cookies (i.e., last only for one browser session) or persistent cookies (i.e., continue in your browser until they are deleted or expire). Some of the cookies we use may be flash cookies or Adobe cookies. While they are harmless, they may contain demographic information and depending on your browser these cookies may not normally be deleted when your cookies are deleted. Please check your browser to determine where these types of cookies are stored and how they may be deleted.

 

While we recommend that you leave cookies turned on as they allow you to take advantage of some of the features of the Sites, you have the ability to control the use and moderation of our cookies. In addition, your browser can help you manage cookies.  You can choose to have your computer warn you each time a cookie is being sent, or you can choose to turn off all cookies. You do this through your browser settings on each browser and device that you use. Each browser is a little different, so look at your browser Help menu to learn the correct way to modify your cookies. If you turn cookies off, you may not have access to many features that make our Platform more efficient and some of our services will not function properly.  There are also general resources for opting out of interest-based advertising available on the websites of the Network Advertising Initiative and the Digital Advertising Alliance.

Similarly, you can adjust your advertising preferences on your mobile device at the device level.  For example, to adjust your advertising preferences in iOS, visit Settings > Privacy > Advertising > Limit Ad Tracking. To adjust your advertising preferences in Android, visit Settings > Google > Ads > Opt out of interest-based ads.

 

Other Websites, Including Mobile Applications and Social Media Platforms:

If you use a social media platform or your mobile device (or other method of communication) to interact with the Sites, that platform or application may have a specific privacy statement that governs the use of Personal Information related to it. Your privacy rights on third-party platforms will be governed by their respective policies.  For example, if you choose to share your activity on third-party social media platforms, the policies of those platforms govern the data that resides there.

 

Our Sites may provide links to other (third-party) websites and apps for your convenience or information. Linked sites and apps have their own privacy notices or policies, which we strongly encourage you to review. To the extent any linked websites or apps are not owned or controlled by us, we are not responsible for their content, any use of the websites or apps, or the privacy practices of the websites or apps.

 

How Can I Access, Correct and Update My Personal Information?

You can access, correct and/or update certain Personal Information that you have provided to us by clicking on "Update Account" within the "My Account" area of the Sites.

 

WHY and HOW Do We Use Your Personal Data?

We use your personal data in the following ways:

 

To Provide the Features of the Sites and the Services You Request 

When you use our Sites, we will use your personal data to provide the requested product or service.  For example, if you make a purchase on thehwogbrand.com, or participate in an event or promotion, we will use the contact information you give us to communicate with you about the purchase, event or promotion. If you contact our consumer services, we will use information about you, such as delivery or payment information, or the product you have purchased to help you resolve a problem or question.

In many cases, to use particular features within our Sites you may need to provide us with additional data or additional consent to use particular data in a certain way.  For example, to share content on social media, you may be required to provide your social media account credentials to sign in.

           

To Communicate Information about our Products, Services, Events and for Other Promotional Purposes

If you are an existing customer of HWOG (for example, if you have placed an order with us), we may use the contact details you provided to send you marketing communications about similar HWOG products or services, where permitted by applicable law (unless you have opted out). In other cases, we ask for your consent to send you marketing information.

We may use the information that you provide to us as well as information from other Having the Will Of God products or services - such as your use of HWOG’s Sites, your visits to or purchases made at hwogapparel.com, your participation in HWOG events and contests (possibly through other HWOG affiliates) - to personalize communications and advertisements regarding our products and services that may be of interest to you.  For registered users, this may include data collected from your interactions with our Sites that are associated with your account across devices. 

 

To Operate, Improve and Maintain our Business, Products and Services

We use the personal data you provide to us to operate our business.  For example, when you make a purchase, we use that information for accounting, audits and other internal functions.  We may use personal data about how you use our products and services to enhance your user experience and to help us diagnose technical and service problems and administer our Sites.

 

To Protect Our or Others' Rights, Property, or Safety

We may also use personal data about how you use our Platform to prevent, detect, or investigate fraud, abuse, illegal use, violations of our Terms of Use, and to comply with court orders, governmental requests or applicable law.

 

For General Research and Analysis Purposes

We use data about how our visitors use our Platform to understand customer behavior or preferences.  For example, we may use information about how visitors to hwogapparel.com search for and find products to better understand the best ways to organize and present product offerings in our storefront.

We may also use your personal data in other ways and will provide specific notice at the time of collection and obtain your consent where necessary.

With Whom Do We Share Your Information?

We only share Personal Information provided to us through the Sites or through our Customer Service Department with your consent or as described in this Policy. Examples of instances in which we share your Personal Information are provided below:

  • HWOG entities for the purposes and under the conditions outlined above

  • Service Providers: processing personal data (including the personal data noted in the "What Information Is Collected and When" section) for business purposes on HWOG’s behalf, for example to process credit cards and payments, shipping and deliveries, host, manage and service our data, distribute emails, research and analysis, advertising, analytics, manage brand and product promotions as well as administering certain services and features. We may use such collected information in order to fulfill your purchase and provide such information, or other Personal Information provided by you, to our service providers and vendors as necessary to complete your purchase and provide our services to you.

  • Third Parties related to Business Transfers: As with any business, it is possible that as our business develops, we might sell, assign, buy, transfer, merge or otherwise acquire or dispose of certain businesses or corporate assets. In the event of such or similar event, Personal Information may be part of the transferred assets. You acknowledge and agree that any successor to or acquirer of us and/or our service provider will continue to have the right to use your Personal Information and other information in accordance with the terms of this Privacy Policy.

  • Agents, Consultants and Related Third Parties: We, like many businesses, sometimes engage other companies to perform certain business-related functions on our behalf so that we can focus on our core business. Examples of these services include, but are not limited to, payment processing and authorization, fraud protection and credit risk reduction, product customization, order fulfillment and shipping, marketing and promotional material distribution, website evaluation, data analysis and, where applicable, data cleansing. In connection with services those partners provide for us, we may provide or otherwise give them access to certain Personal Information, but we authorize them to use this information only in connection with the services they are retained to perform.

  • Legal Requirements: We may also share your personal information with other third parties to the extent necessary to: (i) comply with a government request, a court order or applicable law; (ii) prevent illegal uses of our Sites or violations of our Sites' Terms of Use and our policies; (iii) defend ourselves against third party claims; and (iv) assist in fraud prevention or investigation (e.g., counterfeiting).

  • Other uses: If we intend to use any Personal Information in any manner that is not specified herein, we will inform you of such anticipated use prior to or at the time at which the Personal Information is collected or we will obtain your consent subsequent to such collection but prior to such use. We will honor the choices you make regarding your Personal Information and will inform you about any other intended uses of such information.

PROTECTION and MANAGEMENT of your Personal Data

    • Encryption & Security: We use a variety of technical, administrative, and organizational security measures, including encryption and authentication tools in certain circumstances, to maintain the safety of your personal data. 

Despite our efforts, no website, mobile application, database or system is completely secure or “hacker proof.” You can help keep your data safe by taking reasonable steps to protect your personal information against unauthorized disclosure or misuse. 

    • Retention of your personal data: We retain your personal data for as long as necessary to fulfill the purposes described in this policy, unless otherwise required or permitted by law.  For example, we keep your account profile information for as long as you keep your HWOG account, but we may keep your order history longer to comply with legal obligations.

    • Managing your personal data:  You may have the right to request: (i) access to your personal data (both the categories of data we collect, which is laid out in this policy, and particular types); (ii) an electronic copy of your personal data; (iii) correction of your personal data if it is incomplete or inaccurate; or (iii) deletion or restriction of your personal data in certain circumstances as provided by applicable law. We will not discriminate against you for the exercise of these rights.  If you request to delete your account, you can create a new account on our Platform at any time. If you have a request regarding your personal data that cannot be fulfilled from your account settings, please contact us.

    • Limit the Personal Data You Provide: You can use the Sites and limit the Personal Data you provide either by disabling cookies or by not registering an account with us. If you choose to limit the Personal Data you provide and/or to disable cookies, you may not be able to use certain functionalities of the Sites. For instance, in order to purchase goods and services on the Sites, payment and shipping information must necessarily be provided.

    • Manage your Subscription Preferences: We may send your information by email or text message. If you provide your mobile phone number and ask to receive information by text message, we may provide information in that manner. Additionally, we may send automated text messages (if you provide consent). Where you consent to receive automated text messages from us, please note that your consent includes consent to receive both auto-dialed and/or pre-recorded telemarketing text messages or non-automated messages from or on behalf of Having the Will Of God and its affiliated companies at the telephone number you provided. You further understand that consent is not a condition of purchase and that message and data rates may apply. Additional terms and conditions, including message frequency, are provided at sign-up for any automated messages.

    • Marketing Text and Notifications (if applicable): By entering your phone number at checkout and initiating a purchase, by subscribing via our subscription or by keyword, you agree that we can send you SMS notifications (for your order, including abandoned cart reminders) and SMS marketing offers. Marketing text messages will not exceed 10 per month. You can unsubscribe from any other text message by clicking on the unsubscribe link or texting "STOP". Sending text messages or using automated systems requires that you transmit the telephone numbers or the names of the recipients to our importer. We will store and use this data to show you the analysis and results of the campaign, including the delivery status of messages, the sending status and, in some cases, whether the purchase resulted in a sale. If you decide to use our shortened link in text messages, we will collect information about whether the link was clicked or not and use it to display the results in your analyzes. Any other third party service that you may decide to use outside the scope of smsbump.com (third party shortened link, GA tracking, etc.) you will be referred to their specific third party policies which you must accept. When sending text messages, we will transmit the data to our text message operator to make their delivery. Information is only shared with our operator when a marketing campaign is initiated. If your recipients no longer wish to receive messages, they must reply to the message with STOP or contact us at the email address below so that we can successfully unsubscribe them.

    • For email marketing, you will have an opportunity to change your subscription preferences by clicking on an "unsubscribe" hyperlink contained in all promotional emails sent by us or on our behalf. Please note that while we honor all subscription requests as timely as possible, it may take up to ten business days to become effective. Please be aware that even if you opt-out of receiving future promotional communications, you may, if you utilize the eCommerce features of the Sites, still be sent certain transactional communications related to the purchase or shipment of items purchased. Thus, if you order online, we will send you an email confirming your order and may need to contact you by phone, email or regular mail if we have questions about your order. Additionally, an opt-out will not remove you from messages that we are required to send under relevant laws or regulations. You may ask us not to contact you by text message at any time by responding to a text message after it is received. For automated text messages, you will have the opportunity to opt-out by replying "STOP" to any message received. Please note that you hereby consent to receiving a confirmatory message in response to any opt-out request.

  • Social Media & Other Public Platforms: You may also manage the sharing of certain Personal Information with us when you connect with us through a social media platform or application. Please refer to the privacy settings of the social media platform or application to determine how you may adjust your permissions and manage the interactivity between us and your social media platform(s) or application(s). That said, we want you to be aware that when you post information to public forums, including publicly viewable social media platforms, that information will become available to all who access such platform pages. Please be extremely careful when disclosing any information in chat rooms, forums and other public posting areas. We are NOT responsible for the use by others of the information that you disclose in chat rooms, forums and other public posting areas.

 

How Do We Respond to Do Not Track Signals?

Please note that our Sites do not support "Do Not Track" browser settings and do not currently participate in any "Do Not Track" frameworks that would allow us to respond to signals or other mechanisms from you regarding the collection of your Personal Information or non-personally identifiable information

 

MINORS

The Sites are not directed at nor intended for use by children. We do not knowingly collect or intend to collect Personal Information from anyone who is under the age of 13. If you are under the age of 13, you should not provide any Personal Information to us and you should use the Sites only with the knowledge, permission and involvement of a parent or guardian. We encourage parents and legal guardians to monitor their children's Internet usage and to help enforce our Policy by instructing their children never to provide Personal Information through the Sites without parental consent. If you have reason to believe that a child under the age of 13 has provided Personal Information to us, please contact us and we will endeavor to delete that information from our databases.

 

What If I Access the Sites from Outside of the United States?

Please be aware that the Sites are intended for users in the United States only. If you are visiting the Sites from outside the United States, please note that by using the Sites you will be sending information (including Personal Information) to the United States where our servers are located. We will hold and process your Personal Information in accordance with privacy laws in the United States and this Policy. Please note that privacy laws in the United States may not be the same as, and in some cases may be considered less protective than, privacy laws in other countries. Therefore, by providing your Personal Information, you consent to the use of your Personal Information for the uses identified in this Policy and to the transfer of your Personal Information to the United States as indicated above.

 

CHANGES to Our Privacy Policy

Applicable law and our practices change over time. If we decide to update our privacy policy, we will post the changes on our Platform. If we materially change the way in which we process your personal data, we will provide you with prior notice, or where legally required, request your consent prior to implementing such changes.
